Michael Jordan Testifies He ‘Wasn’t Afraid’ of the Racing Body in Antitrust Trial

The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, stated that his competitive side and status as a newcomer motivated his effort with 23XI Racing to “challenge” Nascar over perceived violations of competition laws.

Financial Stakes and a Will to Win

The owner disclosed operational insights of his racing venture, revealing he invested $40m of his personal wealth into the Cup Series operation launched with business partner Curtis Polk and driver Hamlin.

“Someone had to step forward,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar in its entirety. I felt as far as the sport it needed to be looked at through a new lens.”

Central Issue: Charter Agreements and Contract Pressure

At issue is the expiration of a 2016 deal where Nascar granted each team a “charter”. This system mirrors other major leagues with separately owned franchises, like the NBA’s Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar insisted on charter membership renewals.

Jordan testified for an hour and exited the courthouse to a media frenzy, with onlookers and reporters vying for a view or a photo of the sports legend.

Leading the Legal Charge

23XI Racing is leading the full-court press along with another racing team for Nascar to overhaul a operating model Jordan said is breaking the law to keep two hands on the wheel.

For Jordan and and Heather Gibbs, who testified before Jordan, are events from last September. Gibbs described a frantic and emotional period where the sanctioning body informed teams they had to sign a charter agreement extension. This agreement spanned over a hundred pages detailing team compensation and a guaranteed spot in every race.

Choosing Litigation

Jordan explained that his team and its ally decided their only feasible option was to decline to sign that 112-page package and take the issue to court. The other 13 organizations signed the agreement.

The team owners approached Nascar about potential amendments or extension options. Nascar refused to engage, Jordan said.

The Ultimate Motivation: Winning

But in the end, the resistance against what he saw as a financially unsustainable model was driven by the usual bottom line for Jordan: Success.

“Hamlin persuaded me getting a third driver boosted our odds of winning,” he testified, sharing that he purchased another franchise last year for $28m amid the legal dispute. “So I dove in.”

Gibbs described her push for indefinite franchises, submitted in a formal letter to Nascar. She testified the pressure of the signature deadline didn’t sit well.

She said, the team founder first tried to call and persuade Nascar against forcing signatures, but Nascar’s leader declined the request.

“Don’t do this to us,” Heather Gibbs said Joe Gibbs told Nascar’s executives. She said France replied, “Whether I have 20 charters, that’s what I have. If there are 30, that’s the number.”
